JAKARTA, NNC - Jack Boyd Lapian, who has reported Ahmad Dhani in the case of alleged hate speech in social media, asked Dhani to be arrested after his status is now a suspect. It was delivered by the lawyer of Jack Boyd Lapian, Andreas Nahot Silitonga.
According to Andreas, Ahmad Dhani allegedly violated Article 28 paragraph 2 jo Article 45 paragraph 2 of Law RI Number 19 Year 2016 About Electronic Information and Transactions (ITE) with the threat of six years criminal punishment, and therefore, Dhani should be arrested.
"We hope that during this process Ahmad Dhani can be arrested," said Andreas in Jakarta, Thursday (11/30/2017).
In addition, he explained that in Article 21 of the Criminal Code, paragraph 4 has been set on the conditions that a person can be held with two elements of subjective and objective. Objectively in Article 21 of the Criminal Procedure Code, a suspect who faces sentence of five years or more may be detained.
The subjective element is in accordance to the investigator's assessment, when it is feared that a suspect will repeat his actions, escape, and tamper evidence.
